AGREEMENT
MEG TOVEY STRENGTH AND NUTRITION PTY LTD

Known as "We," "Our," "Us," or "Service Provider",
The other person entering this agreement will be referred to as "Client".
Collectively, all of the above people or businesses entering this Agreement will be referred to as the "Parties".
TERMS

Retreat Inclusions:
The specific inclusions for the retreat are accessible at: www.megtovey.com/ and will be provided on an ‘as needed’ basis at our discretion. -
Payment and Financial Commitment:
By selecting a deposit option with a payment plan, you acknowledge that you are committed to paying the full amount of the retreat prior to the retreat start date. This obligation remains in effect even if you choose to withdraw from the retreat or fail to attend. The deposit is non-refundable, and you are required to complete all scheduled payments according to the agreed payment plan, regardless of any changes in your participation status.
PROTECTIONS & RELATIONSHIP

Copyright Ownership:
Any copyrighted work(s) created or shared as a result of the retreat remain the property of Meg Tovey Strength and Nutrition Pty Ltd. The Client may not share, distribute, or sell these materials without our express prior written permission. -
Trademark Ownership:
All trademarks, whether registered or unregistered, remain the property of the contributing Party. -
Permitted Uses of Material(s):
We grant the Client a non-exclusive license for personal use of materials produced with and for the Client, provided we are attributed reasonably. Sharing with third parties requires our express prior written permission. -
Confidentiality:
Both Parties will treat all information related to this Agreement and the Services in strict confidence and will return all such information if this Agreement is terminated. -
Relationship of the Parties:
This Agreement constitutes a contract for the provision of retreat services and not a contract of employment. We will be responsible for our own taxes and other liabilities, and this Agreement does not create a partnership, joint venture, or agency relationship.
LIMIT OF LIABILITY

Maximum Damages:
The maximum amount of damages for any claim relating to this Agreement or Services is limited to the total cost of the retreat. -
Indemnification:
The Client agrees to indemnify and hold harmless Meg Tovey Strength and Nutrition Pty Ltd from any claims, damages, or losses arising out of the retreat. -
Client Responsibilities:
The Client is responsible for the accuracy of the information provided and assumes full responsibility for the outcomes of the retreat. -
Assumption of Risk:
The Client assumes any risk related to the retreat activities. -
Disclaimer:
We are not providing professional services beyond those described in this Agreement. For additional professional services, a separate agreement is required. -
Guarantees:
We cannot guarantee specific results from the retreat. The Client is responsible for their own results. -
Release:
The Client understands and accepts that results may vary, and dissatisfaction with our methods is not a valid reason for termination or refund. -
Non-disparagement:
Both Parties agree not to make defamatory statements that could harm the other’s reputation.
Force Majeure:
Either Party may be excused from performance obligations due to unforeseen events such as natural disasters, war, or other major disruptions.
GENERAL PROVISIONS

Governing Law:
This Agreement is governed by the laws of Queensland. -
Severability:
If any part of this Agreement is found to be illegal or unenforceable, the remaining provisions will continue in full force. -
Notice:
Notices should be sent via email to the provided addresses. -
Merger:
This Agreement constitutes the final, exclusive agreement between the Parties. -
Amendments:
Amendments to this Agreement must be made in writing. -
Assignment:
Neither Party may assign rights or obligations without proper notice. -
Titles:
Section titles are for convenience and should not be construed as part of the Agreement. -
Dispute Resolution:
Disputes will be settled by alternative dispute resolution (ADR) methods, such as arbitration or mediation, before proceeding to formal legal action.
